Summary/Abstract: Published in draft form for public debate in the fall of 2022, in March 2023 the Romanian Parliament adopts the Law on the prevention of child separation from the family. This law, assumed by Romania through PNNR and benefiting from non-refundable sums of money from the European Union, comes and changes the paradigm regarding the state of vulnerability and natural family relationships. In the present study, we propose to analyze this law through the lens of fundamental human rights and freedoms, to determine if the paradigm shift is limited to the principle of the superior right of the child or if it does not represent an intrusion of the State into family life, which would represent a violation of human rights.
