Summary/Abstract: The sale of another's property, enshrined by the New Civil Code as a valid legal operation, gives rise to rights and obligations towards the main actors of the contract – the seller and the buyer. Stranger to the contract, but with a not insignificant legal figure, the owner of the sold good, a third party to the contract, apparently under the protection of the principle of the relativity of the effects of the contract, can sometimes find himself in the hypothesis in which he finds himself forced to act in order to defend his right to property. Such an approach involves the exhaustive analysis of some civil law institutions, regulated within the Code or some special laws, their correlation and the identification of the means of defence available to him.
