THEORETICAL AND PRACTICAL ASPECTS REGARDING TECHNICAL SURVEILLANCE IN THE CRIMINAL TRIAL

Summary/Abstract: Technical surveillance is often used in judicial practice in Romania, although in many criminal trials there is the possibility of proving the commission of crimes through other evidentiary procedures. The frequency of using special technical surveillance methods requires that the investigator also fully understands the mechanisms behind this evidentiary procedure. It is very important to eliminate the confusions that arise between various special surveillance methods or between them and other evidentiary procedures in general. It is also very important for the investigator to identify the appropriate procedural moment in which to proceed with the use of technical supervision, as the quality of the results is conditioned by this aspect.
