Summary/Abstract: Identity can be defined as the set of traits that attest to the person's uniqueness. The law, which is a set of rules of conduct established to protect the existence and evolution of the person, has developed significantly in recent years, in terms of protecting its identity. For the identification of the person, the law selected only a few of its features, considered to have a greater degree of stability. The legislator proceeded in this way, precisely because, in itself, the identity of the person is in a continuous evolution, transformation. Viewed in its entirety, the person's identity would be difficult, perhaps even impossible, to establish. The name, domicile, marital status, citizenship are enshrined by the legal norms, as elements of identification of the person. However, we encounter in contemporary legal norms concepts such as: European identity or national identity, even constitutional identity, digital identity, gender identity, cultural identity, etc. We consider all of these to be the subject of the right to identity, a right that has been taking shape and is becoming increasingly evident in recent years.
