Summary/Abstract: The creditor’s default may find applications in all types of contracts and non-contractual sources of contractual. However, the focus of this analysis is the contract of sale (both civil and commercial), where the creditor fails to provide the necessary cooperation or refuses to accept the debtor’s exact performance. Injudicial and arbitral practice, the consequences of the creditor’s default are often confused with those of the debtor’s default, despite their distinct legal implications. In this regard, various hypotheses of creditor’s default and its consequences in the contracts in the contract of sale (both civil and commercial) are examined, with acomparative assessment of the obligation for diligent safe-keeping.
