Summary/Abstract: The study examines the economic and social processes that have led to the rise in the value of the contractual implementation of public administration. The transformation of the concept and functions of the contract has allowed consensual solutions to replace traditional unilateral acts of public authority in many new areas of administration. The paper touches on the globalization effects that have strengthened the role of contracts, showing how private and public law solutions have converged. The use of contracts by public administrations has emerged not only in the field of public services, but in virtually all spheres, and a kind of contractual legal order has developed. The relationship of this contractual legal order to traditional legislation requires further study.
