Summary/Abstract: The article analyses European discourse concerning artists’ resale rights. Droit de suite has been criticized as an ineffectual solution. Many of the European legal systems, including Polish one, contained special provisions that in theory legitimized artists to benefit from the resale of their works. Nevertheless, in reality remuneration was not collected. Directive 2001/84/EC of the European Parliament and of the Council of 27 September 2001 on the resale right for the benefit of the author of an original work of art has improved artists’ financial situation remarkably. Unfortunately it did not take place in Poland. Ten years after implementing the Directive’s provisions most of the Polish authors still do not benefit from their resale rights. For that reason, it is essential to conduct a detailed study to find reasons for that situation and highlight the spheres that are essential to improve.
