Summary/Abstract: The article entitled Compensatory liability for so-called hospital infections presents the statutory definition of a hospital infection, refers to relevant statistical data and analyzes part of the doctrine and case law. The author focuses his considerations on the foundations of civil (compensatory) liability for hospital infections, referring to art. 415, 416 and 430 of the Civil Code. Drawing attention to such aspects as the regimes of contractual and tortious liability, causal connection, presumptions and anonymous (nameless) guilt, he discusses the subject matter of the article.
