Summary/Abstract: In France family mediation is of prime importance, but the institutions make little use of it. People expect magistrates to be the “makers of family peace” using the instrument of dialogue. In 2001 at the court of Tarascon, family mediation was set up in partnership with all those of the judiciary involved in family disputes. This initiative has produced a different justice, a real culture of reassurance and pacification because the lawyers deal with the cases differently and the parties involved understand that the courtroom is not a suitable place to put an end to suffering. The effects of this encouragement of family mediation are most important in the whole judicial field. The project has the full support of the Ministry of Justice, of the State, of the Regional Council, of the Comune and other local bodies. The good results are due to the collaboration between them all, but above all to the training of family mediators. It shows how the driving forces of Family Justice are not only juridical but also particularly humane.
