Summary/Abstract: Restorative justice spread into the international overview of the penal policy at the end of the ’80s years. The crisis of the correctional ideology followed to the failure of the reduction of recidivism has promoted the development of a just desert perspective and differentiated programs in the penal law enforcement. Restorative Justice changes goals, practices, actors in the penal justice administration. In a mediation setting victim may show her feelings about the offence meeting offender. The history of the justice leads to a justice oriented to the negotiation against the previous perspective founded on the revenge by the person or by the State. This Justice model also has not be able to guarantee the individual rights and the sense of security. The Restorative Justice gives to the Justice new meanings that the judicial system can’t give now. Any development requires changes not only on the judicial system, but also on the cultural values. The Umbreit Humanistic Mediation may be the theoretical ground for the development of the principles and methods of the Restorative Justice.
