Summary/Abstract: One of the few explicit guarantees included in Article 6 of the Convention, the right to be tried by an impartial court is still restricted in various and unexpected ways. Domestic law includes remedies for the defence of this right, and these must be used, as appropriate, by the judge or the parties, while ensuring a fair balance between the interests of the administration of justice and the interests of the persons involved in the proceedings.
