Summary/Abstract: The Administrative Code has express provisions on the mandate of local councillors to represent the interests of the administrative territorial unit, which do not contain an exhaustive regulation of the institution of representing the interests of the local public administration authority, i.e. the local council. A contrario, in school boards, the representation of the local council can be made both by the local councillor and by any other representative, under the terms of Law no. 287/2009 on the Civil Code, concerning the institution of representation. In essence, the representation of the local council, in the board of directors of pre university educational establishments with legal personality, is not carried out exclusively by a local counselor, so that another natural person may also be empowered to represent it.
