On the Scientific Nature of Legal Scholarship

Summary/Abstract: The ‘scientific’ nature of legal scholarship represents a long-term, more than 150-year-long controversy in which it is often questioned whether legal scholarship is really a science. In this paper, we try to compare the features of unquestioned ‘real’ sciences (meaning specifically natural sciences), with the features of legal scholarship, in order to assess to what extent legal scholarship meets the standards of science accepted in natural sciences. We prove that some features of proper scientificity are thereby not being met by the natural sciences themselves.
