Legal and forensic issues of the crime under Article 310 of the Penal Code

Summary/Abstract: The aim of the article is to discuss the legal and forensic aspects of the crime typified in Article 310 of the Penal Code, as well as to present the results of research on this crime. As a result of the conducted analyses, it was established that the most common objects of the investigated crime are bills of exchange. At the same time, there were no large numbers of cases of counterfeit money. The conducted research also indicates that the most frequently used opinion in the course of proving the crime under Article 310 of the Penal Code is a handwriting expert's opinion. The second most common is an IT opinion. There are also opinions on forensic examination of documents. The research results also indicate that in most cases, the bodies of preparatory proceedings correctly subsume the perpetrator's behavior under the legal provision typifying counterfeit money and means of payment. The article also provides an analysis of possible solutions for increasing security in bills of exchange transactions. The author proposes recognizing bills of exchange as public documents and their appropriate protection against forgery, as well as registering bills of exchange obligations.
