Insanity as a circumstance excluding criminal liability

Summary/Abstract: This article addresses the issue of the insanity of the perpetrator of an act prohibited by law. The main purpose of the article is to present the views of representatives of the doctrine and judicature on the phenomenon of insanity in criminal law. The doctrine represents the position that the psyche of the perpetrator of an unlawful act is of key importance when imposing punishment on him. Therefore, it is important to dispel any doubts as to whether the perpetrator of an unlawful act was capable of recognizing the meaning of the act and of directing his conduct.
