Summary/Abstract: Towards the end of 2018 the Republic of Serbia adopted the Law on Critical Infrastructure, which was followed by some sub-legal acts. It is indisputable that the concept of the Law on Critical Infrastructure built considerably on Council Directive 2008/114/ EC (2008), defining the procedures for effective critical infrastructure identification and protection with a binding effect on Member States and candidate countries for EU membership. However, that new European regulation required the above subjects to enhance the existing concept of critical infrastructure protection in terms of shifting from measures to protect individual critical assets to preventative approach based on risk assessment and focused on strengthening the resilience of critical entities and capabilities to provide services. Although Directive (EU) 2022/2557 sets the deadline for its transposition by October 2024 for EU Member States only, there is no doubt that certain obligations will also arise for the Republic of Serbia relating to chapter 24 of the negotiating process for joining the EU. In this connection, the subject of this paper is the current national and new EU regulations in the area of critical infrastructure with the emphasis on the problem area of further alignment of Serbian legislation with the EU acquis.
