Summary/Abstract: Strategic litigation against public participation is not a new phenomenon, nor is it endemic solely to the US legal system in which they were first observed. Many examples of SLAPPs exist in the legal system of EU Member States. The EU’s Directive proposal for combatting SLAPPs is a step in the right direction – even given certain criticisms which can be raised to its content. The present article analyses the content of the current shape of the Directive proposal, the EU’s competence to adopt such an act and its implications on human rights and court proceedings in EU Member States.
