Summary/Abstract: In this article, we aim to analyse the interpretation given by prosecutors and judges to one of the specific elements of the constitutive content of the offense of high-risk drugs administration without complying the legal conditions. The offence is defined by the disposition of art. 7 of Law No. 143/2000 on the prevention and combating of illegal drug trafficking and consumption.In our opinion, without a correct understanding of the essential requirement, the legal framework related to certain factual situations, may raise the issue of legal classifications that are not beyond criticism.
