Summary/Abstract: The issue of including the observation period of the insolvency procedure within the 12-month term stipulated in Article 112(3) of Law No. 85/2014 is not a novelty in the specialized literature of this branch of law. Given the longstanding presence of the topic regarding the exceeding, in practice, the observation period in the sphere of doctrinal debates, we consider it relevant to focus on the solutions regulated by the legislator to ensure compliance with this normative requirement. This paper aims to analyze the remedies available to the syndic judge to ensure compliance with the observation period deadline – specifically, the adjudication of challenges to the preliminary table in a single ruling and the provisional registration of contested claims. The analysis will examine their operational mechanisms, application constraints and the sanctions for non-compliance, in relation to the interplay between the provisions of the special law and those of common procedural law.
