Summary/Abstract: Criminal law of the Republic of Moldova safeguards the life of a person not the life of a human being in general. The life of an unborn human being is protected partially in Romania. This is because the product of conception does not have the status of a person, while a pregnant woman is free to decide either to terminate or to continue her pregnancy. This Study proposes certain legislative amendments aimed to provide for a more efficient criminal-law defence of an unborn human being. Such a defence cannot have an absolute feature as the right to life of a person is not an absolute right either.
