LEGAL PROTECTION OF CHILDREN IN INHERITANCE PROCEDURES AFFECTED BY GENDER-BASED VIOLENCE

Summary/Abstract: Gender based violence within the family poses a serious challenge for the legal system, especially in the context of inheritance proceedings. This paper addresses the legal aspects of protecting children affected by gender based violence and its impact on inheritance disputes. An analysis of the current legal framework identifies key shortcomings in the legal protection of children in cases where violence and inheritance disputes are intertwined. Special emphasis is placed on the application of legal norms in practice, as well as on obstacles that hinder the exercise of children's rights in these complex situations. The paper further discusses the existing mechanisms of legal protection, highlighting the need to improve the legislative framework and strengthen the interdisciplinary approach in addressing these issues. In this context, the role of judicial authorities, social services and other professionals involved in the child protection process is analyzed. The aim is to provide a comprehensive overview of legal challenges and recommendations that can contribute to more effective protection of children in inheritance proceedings affected by gender based violence.
