Summary/Abstract: This article aims to answer the questions of what character – factual or legal – unwarranted actions under Chapter "Fifteen" of the Code of Administrative Procedure possess, as well as whether the unwarranted actions contain (constitute) a declaration of will. For this purpose the case-law of the Supreme Administrative Court has been examined.
