The Police Officer as minister iudicis. Analysis of the Rules of Police Killing in the Framework of Thomistic Ethics

Summary/Abstract: This study examines specific state actions that counteract harm to the welfare of the community, namely the lethal actions of police officers. To this end, it is first shown how they are distinguished from other types of state killing, namely judicial killing and killing in the midst of armed conflict. Next, two main types of lethal police actions are considered: (1) actions that carry the risk of depriving someone of his or her life and (2) actions aimed directly at the death of an individual. It is indicated in detail when police officers have the authority to undertake such actions. The issue of lethal police actions has been analysed from a Thomistic perspective. In addition to referring to the writings of Aquinas, the positions of contemporary scholars drawing on the Thomistic tradition – John Finnis, Edward Feser, Gregory Reichberg, Wendy Hicks and Benjamin Wisniewski – have been critically analysed.
