66. Pension for age limit. Seniority bonus. Additional points for work carried out in a higher job group

Summary/Abstract: It follows from Article 16 of Law no. 3/1977 that the seniority bonus is granted only for a full year of activity in the higher group of work and not for fractions of a year. Therefore, for the 9 months of service in group I, there can be no seniority bonus, as the appellant claims. The legal rule is clear in this respect, for each year worked in Group I, one year and six months is calculated as seniority. However, the additional points provided for in Article 782 of Law no. 19/2000, introduced by GEO no. 100/2008, are awarded for each year of additional pay, i.e. each month of additional pay, and not for the entire period of activity in the higher work group. Since, as already stated, no seniority bonus could be awarded for the 9 months of service in Group I, no additional points could be awarded under GEO no. 100/2008.
