Customer needs analysis in a group insurance contract

Summary/Abstract: In recent years, in an effort to increase the protection of customers of insurance contracts, the legislator has introduced an obligation, directed at the entities with which the customer concludes an insurance contract, to ensure the usefulness of the insurance offered to a particular customer – by examining and tailoring the insurance contract to the needs of that customer. However, it is questionable whether and to what extent the obligation to assess the customer’s needs and requirements should be implement- ed in the case of insurance on someone else’s account, in particular group insurance. The obligation relates to the customer – it is the customer seeking insurance cover, the policyholder or the insured, but not the future insured in a group insurance contract. There are other ways of ensuring that the in- surance offered is beneficial to each individual who enters into a group insurance contract, including the insurance product approval process, in which the product manufacturer defines the target market for the product and the group of clients to whom the product is addressed. However, group life insur- ance contracts with investment character are subject to different requirements in this respect due to the specificities of this type of insurance contract.
