Summary/Abstract: The plea agreement represents a consensual way of resolving criminal cases and is one of the instruments of efficiency and economy of the criminal proceedings. In the paper, the authors will analyze the legal provisions that regulate the conditions for concluding an agreement, the course of negotiations between the parties on the same, the court’s decision on whether to accept or not accept the agreement, then the shortcomings of the legal provisions that regulate the agreement with an emphasis on the practical application of this institute, as well as the dilemmas that arise in practice, and at the end give certain proposals de lege ferenda with the aim of creating better legal solutions in the future.
