Establishment of the more favourable rights in case of posted employees

Summary/Abstract: The legislation in force establishes the right of a posted employee to benefit, during the posting period, from the more favorable rights, whether those granted by their original employer or those provided by the host employer. To determine the more favorable rights, a global comparison must be made between the rights applicable at the level of the two employers involved. However, salary-related rights that are not granted as a result of work performance, such as monetary amounts provided for social reasons or due to working conditions, must be compared individually and granted separately.
