Insurance Coverage in Life Insurance and Presumption of Death – Selected Legal Issues

Summary/Abstract: The aim of the article is to present selected issues related to the legal consequences of presum- ing a life insurance policyholder dead under insurance law. The following matters are discussed, namely the determination of the expiry of the insurance cover for such a person, the establishment of the beginning of the limitation period for the payment of benefi ts by the insurer as well as unjust enrichment when the person declared dead has been found after the payment of the sum insured to the entitled parties. The article presents solutions to the above-mentioned problems.
