Summary/Abstract: This article aims to analyze the different position in criminal procedure of juridical persons in comparison with individuals as victims of crime. The new Criminal Procedure Code (OJ, 86/28 October 2005) grants juridical and physical persons equality in trial: they can claim damages for a crime. The author analyses the preconditions for the admission of juridical persons to trial and the possible protection of their rights in criminal and civil procedure. The conclusion is that during preliminary procedure juridical persons have some rights, but no guarantees for these rights.
