Criminal Law Protection of Online Commerce

Summary/Abstract: Online commerce has enabled many new ways of shopping that may also give rise to new types of abuse. These need to be addressed by the legislator, including, if necessary, through criminal law. However, the traditional criminal law framework may not be able to deal with such cases. Thus, the possibilities for criminal law assessment of credit card, smartphone and netbank abuse may need to be reconsidered. As a general rule, it is appropriate to try to apply the previous solutions, but if these are not satisfactory, new criminal law responses may be necessary. This study seeks to answer these questions.
