Summary/Abstract: The paper examines how covert monitoring and recording is treated in legal theory and what legal powers authorities have to implement it in the Republic of Serbia and a number of European countries. Using content analysis of existing research, historical and comparative methods, as well as scientific description, synthesis and correlation of this procedural institute in existing legislation and legal theory, research findings showed that the Criminal Procedure Code of the Republic of Serbia stipulates that, besides police, this special evidentiary action can also be implemented by civil and military security services. This contradicts the stipulations from the comparative procedural codes of the countries in the researched sample.
