Summary/Abstract: This paper examines whether a will is considered void if it was created forreasons that are already taken care of or for future care that has been agreed upon. It analyzesthe discrepancies in case law that arise from the motives behind the will. The paper alsoexplores the motive behind the distribution of assets in a will, focusing on the comparisonbetween a will and a donation contract. If a testator expresses a desire for future care to beprovided for them until the end of their life, it is assumed that the will is void based on Article42, b. of the Inheritance law.
