Summary/Abstract: The article discusses selected legal issues related to the identification, definition and characteriza-tion (using terminology and methodology appropriate for legal science) of the phenomenon ofpersuasive pornography and the effects of its consumption in the context of the subliminal mes-sage present in it, which stimulates the recipients in a way that bypasses the control of conscious-ness and can lead to problems with their physical and mental integrity, especially those related togender identity, or even suppression or change of their previous sexual orientation. In the author’sopinion, this clearly impinges on the recipients’ right to respect for their private lives, particularlywith regard to their own determination of their gender identity. The author also analyzes the le-gal nature of the subliminal message called subliminal perception (stimulation) against the back-ground of the legal regulations in force in the EU and the Republic of Poland. In addition, he dis-cusses selected aspects of hypnotic induction as manifestations of various forms of psychologicalinfluence (and even psychomanipulation) on the recipients’ gender identity and sexual orientation.The author presents the view that the recipients (users) of this type of content require special legalprotection and should be classified as a special type of consumers.
