Summary/Abstract: The new Family Code of Cuba is inserted among the regulatory bodies that have included pregnancy by surrogacy in its regulation, in its partial modality. It is a development based on altruism and the solidarity of third parties, hence its name. To this end, the figure has been shielded with a key of legal content that establishes the budgets to be able to agree on pregnancy in such circumstances, demanding, among other requirements, the existence of close and demonstrable parental or friend ties between the people involved. Added to this is one of medical content, requiring strict compliance with requirements in that order, controlled by health personnel. Finally, this shield is sealed with strict judicial control, following a prosecutor’s opinion on the request for the procedure, so that the doctor cannot proceed with the embryo transfer until the judicial resolution containing the authorization is accredited.
