Summary/Abstract: In this article, adopting the theoretical deductive method, based on legislative, bibliographical and jurisprudential research, the aim is to investigate in which extension the practice of domestic or family violence and parental alienation impacts on the powers and duties that emanate from the exercise of family power or parental authority. Although proof of guilt is no longer required as a requirement for the dissolution of family entities, demonstrating that the adverse party committed acts defined as domestic or family violence or parental alienation may prove to be relevant for the regulation of custody and cohabitation arrangements between fathers and mothers with their children after divorce or dissolution of a stable union.
