Summary/Abstract: This article examines the problem of competition between the personal and public interest in the issuance of non-normative administrative acts, which stems directly from the principle of proportionality in the administrative process. The presentation attempts to give theoretical guidelines for the hierarchical arrangement of the different types of interest cited in the principle, since finding a balance between them is difficult to achieve in practice. However, the realization of this balance is a guarantee that the administrative body has taken the fairest decision, and fairness is a guiding factor for the correct application of the principle of proportionality.
