Summary/Abstract: Given the particular importance of the social relations regulated by the rules of constitutional law with regard to the principle of the separation of powers in the state, the need arose to state an effective mechanism to ensure balance and loyal cooperation between the powers of the state, guaranteeing cooperation between the various state bodies in the performance of their functions. Thus, in a situation where there is a conflict arising from a direct, unmediated violation of the principle of the separation of powers in the state, the competence to solve the conflicting legal situation lies with the Constitutional Court, according to the Constitution.
