Secular versus canonical authentic interpretations of the law

Summary/Abstract: In Polish legal science, the identification of different types of interpretation in terms of their binding force highlights the distinction between authentic interpretation, valid interpretation (interpretation that is binding if the law indicates it is binding), operative interpretation and doctrinal interpretation. If the result of an interpretation is binding to an extent, it is unnecessary to implement substantive treatments defined by another typology that distinguishes between linguistic (including literal), systematic, systemic, functional, dilatory, narrowing, historical and legal comparative types of interpretation. Although the same is true in the study of canon law, the canonists treat various types of legal interpretations differently. This is the case for authentic interpretation, which, in canonical terms, is closely connected to valid interpretations of the law. The relationship between the two kinds of interpretation is different in secular science. The current study focuses on authentic interpretation and thus also valid interpretation and operative interpretation. It aims to grasp the differences in the roles that secular and canonical authentic interpretations play in the practice of law interpretation and to formulate de lege ferenda conclusions for a canonically inspired conception of this interpretation in secular law. This concept assumes that the recognition of the binding force of an authentic interpretation implemented by the legislator requires a specific institutional framework.
