Determining the Administrative Justice: The Perspective of an Administrative Court in Albania

Summary/Abstract: The draft for the Administrative Court is one of the most important and controversial law-drafts in Albania because of the large interests groups involved in this project. This essay is concentrated on the national and international progresses of administrative law and its issues. To define the administrative justice and law it means to treat a lot of important issues that are connected with the state of law and to have in regard the public sector and administration. This essay, fi rst of all, contributes in understanding the term of “administrative justice” and with this regard we have undertaken a complete analysis of juridical facts. Doing a macro analysis is possible to include and to take into account the interests of all targeted groups, with the aim to turn this draft more applicable and more representative for the public interest. In a second place, this work does a critical analysis, under a legislative point of view, of the draft for the Administrative courts regarding judicial control of administrative processes, but also trying to bring forth eventual improvements to this bill.
