Summary/Abstract: Every natural person has the right to a healthy environment, to free access for recreation in publicly owned green spaces. The retrocession of a public park violates the provisions of art. 10 para. (2) from Law no. 10/2001 regarding the legal regime of some buildings taken over abusively between March 6, 1945 and December 22, 1989. The court called to rule on the legality of the mayor's order to return a large area of a park must provide sufficient evidence, directly clarifying whether or not the land surface in question is of local public use or interest.
