MURDER ABOUT HUSBAND, WIFE OR RELATIVE CLOSE OR FAMILY MEMBER

Summary/Abstract: In this work, In this paper I have tried to analyze the crime of murder, and especially that committed in the family environment: "Murder committed against a husband, wife or a close relative" or on a family member, art. 145 para 2, e1) C.P. to RM. Regarding the chosen research space - we consider that most of the causes and conditions for crimes committed in the Republic of Moldova can be explained and analyzed in relation to the same category of crimes committed in the neighboring country - Romania. Thus, it was established that there are families, whose climate creates premises for the formation of criminal personality such as: conflicting families, hyper-authoritarian families and hyper-permissive families, etc. So, the family environment can be appreciated in terms of structure, economic and social conditions and educational deficit. The family environment can have very different legal, social, moral, pedagogical deficiencies, related to situations such as: infidelity, abandonment, divorce, cohabitation, death, drug addiction, sexual vices, etc., without mentioning the very absence of the family environment, as in the case of orphaned, abandoned children in public care.
