Summary/Abstract: The ability of the court to take measures regarding the exercise of parental authority should not be seen as punitive towards the parent who will not exercise parental authority. The application of the measure provided for by Article 398, paragraph 1 of the Civil Code does not diminish the parental status and should not be equated with the situation of a parent deprived of parental rights.
