Summary/Abstract: The liability of the judge in the Romanian judicial system is specifically governed by Law No 303/2022 on the status of judges and prosecutors, there being four forms of legal liability. There is frequent public discussion about the need to adopt a law on the liability of magistrates. Even if a special law on the liability of judges has not been adopted, there are sufficient legal provisions in the current legislation to enable the liability of judges in all its forms. The types of liability borne by judges will be briefly analysed in this article, however, this is nevertheless sufficient to highlight the fact that the liability of judges is an exception to ordinary law and is of a special nature in relation to certain forms of liability, given the specific nature of the public office they hold. When we speak of the liability of the judge, we are obviously referring to liability for acts connected with the exercise of the profession, since for acts which are not connected with the performance of official duties, a judge will be liable like any other citizen.
