Summary/Abstract: In the context of an increased popularity of cryptocurrencies recently, it is important to understand how these digital assets can be transmitted, legally and efficiently, in the event of the death of their owner. This study analyses how cryptocurrencies work, going through technical aspects related to blockchain technology, cryptographic wallets and keys, as well as transactions and confirmations of operations. Likewise, the study examines the legal aspects related to cryptocurrencies, with a focus on the diversity of their status in global jurisdictions, as well as the impact on succession planning. In addition, the exposed case studies present concrete examples related to cryptocurrency successions, identifying the key challenges that individuals and heirs face in the transfer process. In conclusion, the article offers solutions and recommendations related to succession planning having as object cryptocurrencies, including as concerns the legal and fiscal aspects that those interested in an evolving digital legacy should consider.
