On the Institution of a Public Hearing – an Analysis from the Theoretical Perspective and Parliamentary Practice (V–IX Term of the Sejm of the Republic of Poland)

Summary/Abstract: The purpose of the study is to assess the institution of the public hearing in thelaw-making process. The study addresses the issue of whether the institution ofpublic hearing is a real or illusory instrument in the law-making process? On onehand, theoretical issues concerning the institution of public hearing were takeninto account, and on the other hand, statistical data concerning the application ofthis institution in the 5th–9th term of the Sejm of the Republic of Poland werepresented. The constitutional practice of the institution of public hearing in thisperiod shows that, the Sejm committees use this power quite sparingly. Since theentry into force of the regulation concerning this institution covering the periodfrom the 5th to the end of the 9th term of the Sejm, only 34 public hearings covering 46 bills out of a total of 5855 bills have been held. This formed the basis for theformulation of conclusions postulates.
