Originating from the Latin term function is, initially meaning work or practice, the term now has broad applications in various fields, including mathematics and biology. In the context of social sciences, the function is defined as the consequence that an element or activity has on a given system, fulfilling its needs or requirements. The concept of function in law is widely used in Western legal theory, with various meanings that sometimes stray from the strict scientific understanding of the terms used. The functional analysis of the legal system highlights the indispensable role of law in maintaining social balance and ensuring the coexistence of freedoms in society.
