Summary/Abstract: The world has been substantially changed by digitisation. Big data, automation, AI, have also transformed creative, innovative processes, bringing development and economic growth, but also potential risks for people's safety. There is thus no progress of society without creativity and innovation. But with the rapid development of AI systems comes a wealth of opportunities, as well as many challenges. The existence of text generators that can create copyright works, systems that give us imitative or even new works of art, that can create music, or develop software, assistive robots, health or emotion monitoring systems, raises the question of whether or not AI is dangerous for society and intellectual property in particular. Recent years have shown how far human creativity can go, but also how easily our right to privacy or security can be compromised.Who is the author and who owns the copyright to the creation? How can plagiarism be avoided when AI systems are programmed to analise and render content that already exists? Who is the inventor and how can patent rights be established? How do we avoid processing large volumes of data, biometric data, sensitive data? All these pertinent questions have been the subject of many press articles, books and studies, but it is clear that the presence of AI in creative processes raises ethical questions about how it should be managed. And this can only be achieved through the adoption of regulations to ensure the responsible use of AI and the rapid harmonisation of international standards.
