Summary/Abstract: In the context of a non-unitary jurisprudence in the field of insurance recourses, the pronouncement of Decision no. 18 of October 23, 2023 by the High Court of Cassation and Justice in the panel competent to judge appeals in the interest of the law comes to clarify some of the inconsistencies. The paper aims to analyze its effects in the litigations between the plaintiffs and the insurers and to offer certain solutions intended to enhance its role of unifying the practice of the courts.
