Summary/Abstract: Private enforcement agents by law are private individuals to whom the state entrusts the compulsory enforcement of private claims. But what happens when private judicial enforcement officers abuse these powers or otherwise harm creditors or debtors? This raises many questions, especially concerning the nature of human rights. This paper examines precisely these issues and to what extent the state is responsible for the actions of private judicial enforcement officers.
