Summary/Abstract: Traditionally, constitutional law considers three elements of statehood - territory, population, and government. However, unlike it, international law recognizes at least four, with many authors identifying other necessary state-forming elements. Among them, the most important is the element of „capacity to enter into relations with other states,” recognized in the Montevideo Convention. The current development presents some of these elements and what their place could be in constitutional legal doctrine.
